In a decision on Friday, Minister Alexandre de Moraes denied the Christmas pardon request to former federal deputy Daniel Silveira.
Silveira was sentenced to eight years and nine months in prison for attempting to obstruct the powers and for coercion during the legal process by making offensive remarks and threats to Supreme Court ministers.
Alexandre de Moraes stated that Silveira does not have the right to the pardon as he was convicted of attempting to impede the functioning of the powers, a crime not covered by the presidential decree signed by Luiz InĂ¡cio Lula da Silva at the end of last year.
The minister upheld his previous decision to revoke Silveira’s conditional release and ordered him to serve the remainder of his sentence in a semi-open prison regime.
